In the wee hours of a recent Sunday morning, a vehicle traveling on a San Antonio, Texas roadway veered into oncoming traffic. The vehicle hit a truck, which collided with a third vehicle. One of the vehicles wound up in a ditch. Another vehicle, a truck, was lying on its side when police arrived at the scene.
Sadly, as is often the case with head-on collisions, there was a fatality in this incident. Several other people who suffered injuries were transported to a nearby medical facility for treatment. One of the truck drivers, police later said, submitted to a field sobriety test and will now be facing DUI charges in court.
Navigating the aftermath of a Texas motor vehicle collision
For those who survive a collision, the top priority should always be to seek immediate medical attention and to monitor their health during the days and weeks that follow the incident. When a fatality has occurred, it is important for a community to provide support to family members of the decedent. In either case, restitution may be sought by filing a personal injury or wrongful death claim in civil court.
The key to winning injury or wrongful death claims is to gather evidence documenting that certain elements existed at the time of the collision. The court must be convinced that the defendant owed a duty of care, was negligent in fulfilling that duty and directly caused an accident resulting in damages because of his or her negligence. Before heading to court, it is always best to consult with a Texas attorney who is experienced in this type of litigation.
