Fatal car vs. pedestrian accident

On Behalf of | Mar 18, 2023 | Wrongful Death

A recent Texas car accident resulted in the death of a pedestrian in Austin. It is said to have been the city’s 18th traffic fatality to date in 2023. Few details were available in the aftermath of the tragedy. The case has been assigned to the city’s homicide unit, and a request was made for anyone with information to contact the Capital Area Crimestoppers Program.

Events leading to the crash

The accident occurred at 8:50 p.m. on a recent Sunday night. It took place at a service road and highway intersection. According to police, the car struck an individual who was walking nearby.

The pedestrian was killed due to the impact of the crash. Police said the driver of the car that struck the pedestrian remained at the crash scene and was cooperative with investigators. Authorities continue to investigate the cause of the wreck.

How an attorney can help

Police in Texas may learn through their investigation that the car driver caused the pedestrian’s death due to negligent driving, such as texting while driving or speeding. In this situation, the surviving loved ones of the pedestrian may opt to file a wrongful death claim against the car driver, seeking the reimbursement of monetary damages sustained due to the fatal wreck. Once liability is formally established, based upon proof of negligence, claims for damages will be adjudicated. No amount of money can change what has already taken place. However, a monetary damage award may help with covering the deceased pedestrian’s funeral costs and other losses stemming from the fatal accident.
