How an attorney can help
Texas police might learn through their investigation that one of the car drivers caused the wreck due to careless driving, such as speeding or texting while driving. In this situation, if the deceased driver is found to have caused the crash, the injured driver and passenger from the other car may choose to file personal injury claims against the deceased driver’s estate. The claims can also be filed against anyone with an ownership interest in the car the driver was operating at the time of the accident. Meanwhile, if the injured driver is believed to have caused the crash, the injured passenger may file a personal injury claim against him or her. Likewise, the loved ones of the deceased driver might choose to file a wrongful death claim against the injured driver, seeking damages to cover funeral costs and other accident-related losses.
